Gainesville DUI Arrest

I handle a lot of DUI cases. Reflecting back on my career that started in 2003, I cannot remember a time that I was not handling a case for a client accused of driving under the influence. There are many issues that arise in DUI defense. I have made the argument before that in many ways a DUI defense is more complicated than some felony matters.

There are two primary elements the state must prove in any DUI case. The first is whether the accused was in actual physical control of a vehicle. The second element is whether the accused’s normal faculties were impaired by alcohol or a controlled substance or whether the person had an unlawful level of alcohol or controlled substance in their system.

This article made me think about the DUI arrests that I have handled in which Glassman & Zissimopulos Law raised the defense that our client was not in actual physical control of a motor vehicle. Depending on the facts of a case, this may be a valid defense. The location of the keys, the location of the accused within the vehicle, and the operability of the motor vehicle are some of the considerations that need to be analyzed to determine whether or not the state can prove that first element beyond a reasonable doubt.
