An example of innocent misrepresentation deals with car insurance. A company will ask whether or not a car is kept in a garage. If a customer marks the car as being garaged but the car is involved in an accident while parked outside the house, the insurance company will likely cite misrepresentation and avoid compensating the individual with the wrecked car. This is just one example of many where insurance companies take advantage of the customer.
Often, the questions consumers are asked when filing for insurance are extensive, ambiguous and confusing. Further, companies do not fact check the accuracy of customer answers. And why should they?
